Terms of Service
1. Acceptance of Terms
By creating an account on BizBotify ("Service"), operated at bizbotify.com, you ("Customer", "you") agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, do not create an account or use the Service.
2. Description of Service
BizBotify is a cloud-based WhatsApp Business communication platform that enables businesses to:
- Manage inbound and outbound WhatsApp conversations
- Build and deploy automated chatbot flows
- Send broadcast campaigns using approved WhatsApp message templates
- Analyse conversation and campaign performance
- Manage contact lists and team members
The Service operates through the official Meta WhatsApp Business API. You must have a valid WhatsApp Business Account approved by Meta to use the core messaging features.
3. Accounts and Registration
- You must provide accurate, complete, and current information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately at support@bizbotify.com if you suspect unauthorised access to your account
- One account per organisation. Each account may have multiple team member users
- You must be at least 18 years old to create an account
4. Trial Period and Subscription
4.1 Free Trial
New accounts receive a 14-day free trial with full access to all platform features, beginning when your email address and phone number are successfully verified. No credit card is required to start a trial.
At the end of the trial period, your account will be placed in read-only mode. You can view existing conversations and data but cannot send messages, create campaigns, or modify settings until your account is activated. Contact us at support@bizbotify.com to activate your subscription.
4.2 Paid Subscriptions
Paid subscription details, pricing, and billing terms will be presented to you at the time of activation. Fees are charged in advance for each billing period. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms.
4.3 WhatsApp Conversation Fees
The Meta WhatsApp Business API charges conversation-based fees directly to your Meta Business account. These fees are separate from your BizBotify subscription and are billed by Meta, not by us. You are responsible for understanding and paying Meta's pricing.
5. Acceptable Use Policy
You agree to use BizBotify only for lawful purposes. You must not:
- Send spam, unsolicited messages, or bulk messages to contacts who have not opted in to receive them
- Violate the WhatsApp Business Policy or WhatsApp Commerce Policy
- Use the Service to send content that is illegal, fraudulent, defamatory, harassing, or hateful
- Impersonate any person, business, or entity
- Use the Service in any sector prohibited by WhatsApp's policies (e.g., sale of weapons, drugs, adult content)
- Attempt to gain unauthorised access to our systems or another customer's data
- Reverse-engineer, decompile, or disassemble any part of the Service
- Resell or sublicense access to the Service without our written consent
- Use automated tools to scrape or extract data from the platform
We reserve the right to suspend or terminate accounts that violate this policy, without notice, and to report violations to Meta and relevant authorities where required.
6. WhatsApp Business Policy Compliance
By using BizBotify, you acknowledge and agree that:
- You will comply with all applicable WhatsApp Business and Commerce Policies, as updated by Meta from time to time
- You are solely responsible for obtaining valid opt-in consent from your customers before sending them WhatsApp messages
- All message templates you submit for Meta's approval must be accurate and comply with Meta's template guidelines
- You will provide a clear and accessible opt-out mechanism to your customers
- You will not use the platform to send prohibited content categories as defined by Meta
BizBotify is not responsible for the suspension or restriction of your WhatsApp Business Account by Meta due to policy violations on your part.
7. Your Data and Content
You retain all ownership rights to the content you create, upload, or transmit through BizBotify, including message templates, contact lists, and campaign content ("Customer Content").
You grant BizBotify a limited, non-exclusive licence to store, process, and transmit Customer Content solely as necessary to provide the Service to you.
You represent and warrant that you have all necessary rights, licences, and consents to submit Customer Content through the Service and to allow BizBotify to process it as described in our Help & Guides Privacy Policy.
8. Intellectual Property
BizBotify and all associated software, designs, trademarks, and content are owned by us or our licensors. Nothing in these Terms grants you any right to use our name, logo, or trademarks without our prior written permission.
We welcome feedback and suggestions. Any feedback you provide may be used by us to improve the Service without obligation to you.
9. Service Availability and Changes
- We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice
- Features available during the trial may differ from paid plans
- We are not responsible for any interruptions caused by Meta's WhatsApp API or other third-party services
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- No indirect damages — BizBotify will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or loss of goodwill, even if advised of the possibility of such damages.
- Liability cap — Our total liability to you for any claim arising from or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) INR 10,000.
- No warranty — The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
11. Indemnification
You agree to indemnify, defend, and hold harmless BizBotify and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including WhatsApp users' privacy rights
- Any Customer Content you transmit through the Service
12. Termination
12.1 By you
You may close your account at any time by contacting support@bizbotify.com. Account closure takes effect within 5 business days. Data will be deleted within 30 days per our Privacy Policy.
12.2 By us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. We may also terminate accounts with 30 days' notice for any other reason. On termination, your right to access the Service ceases and we may delete your data per our Privacy Policy.
13. Governing Law and Disputes
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in India.
Before initiating any legal proceedings, you agree to first attempt to resolve disputes informally by contacting us at support@bizbotify.com.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and display a prominent notice in the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
